Elise Marshall Obtains a Defendant’s Verdict on Plaintiff’s Claim of Crush Injury while Using a Mechanical Lift

Elise Marshall obtained a Defendants’ Verdict in Barnstable Superior Court after a multiple day jury trial. Plaintiff sued Defendant commercial landlord, storage facility owner, and elevator company after he sustained crushing injuries to his foot and toes while using a mechanical lift. Attorney Marshall successfully demonstrated to the jury that the injuries were caused by the Plaintiff’s own negligence because he failed to adhere to multiple warning signs instructing users that the lift was not intended for passenger use. The evidence established that the mechanical lift was licensed, inspected and had a valid certificate from the Commonwealth’s Elevator Inspector Office at the time of the occurrence. The trial was conducted before the Honorable Gregg Pasquale. Colby v. 540, LLC et al, 2072 CV 00393 (Barnstable Superior Court).
