7-17-2026 – Patricia Noyes Corrigan obtained a summary judgment decision in favor of her clients, public transportation companies. The case arose out of the death of a person who had been a passenger on a public bus in Mashpee, Massachusetts. The passenger requested to exit the bus, did so at an agreed location, and was observed on video standing safely outside of the roadway as the bus left the scene. At some point after the bus left the scene, the former passenger entered the roadway, was struck by vehicles and died as a result of her injuries. The Court concluded that the transit operators did not owe a continuing duty of care to the passenger once she had safely exited the bus on which she had been a passenger. The Court concluded that the decedent controlled her own safety once she safely disembarked from the bus, was no longer reliant on the bus company for her safety and she made the decision to enter the roadway as a pedestrian.
