Edward R. Gargiulo is a founding partner of   Gargiulo / Rudnick, LLP, which was organized in 1986 where he specializes in complex civil and criminal litigation in both state and federal courts.

Mr. Gargiulo also served as an Assistant District Attorney for Middlesex County from 1976–1980 where he was a senior trial attorney and personally prosecuted many highly publicized criminal trials. In 1982, he was a candidate for District Attorney of Middlesex County, the most populous county in the Commonwealth of Massachusetts. From 1983–1984, he served as Counsel to the Speaker of the Massachusetts House of Representatives where he provided legal advice to the Speaker on pending legislation and interacted on a daily basis with constituents, businesses, lobbyists, state representatives, committee chairpersons, etc. regarding a wide area of legislative issues. Additionally, throughout his career, he has remained active in the political process on a local, state and national level.

Mr. Gargiulo has tried hundreds of cases in state and federal courts in the Northeast and elsewhere in the United States. Mr. Gargiulo has received Martindale-Hubble’s highest rating for legal ability. Notable trial results include a multitude of acquittals in criminal cases; substantial plaintiff’s personal injury verdicts and numerous defendants’ verdicts or conservative jury awards while representing interests of civil defendants.

   CAREER HIGHLIGHTS

  • Assistant District Attorney for Middlesex County from 1976–1980.

  • 1983–1984, he served as Counsel to the Speaker of the Massachusetts House of Representatives.

  • Dismissal with prejudice of all claims against a subcontractor in multi-party construction litigation. Also involved ancillary litigation under M.G.L.A. c 93A and 176D between subcontractor and his insurance carrier which denied all defense and indemnity and ultimately agreed to assume full costs of defense of litigation which spanned over a three year period.

  • Substantial plaintiff’s personal injury verdicts, including the highest personal injury jury verdict ever awarded in Barnstable County, Massachusetts;

  • Acquittal of an employee of a major, national lending institution charged with engaging in falsification of loan applications submitted to a federal lending institution where government alleged millions of dollars of losses to the lender.

  • Favorable settlement of indemnification action against federal lending institution under statute requiring employees to be reimbursed for legal fees and costs incurred under specified circumstances.
